CC&R AND BYLAW AMENDMENTS
Posted By rhart on September 1, 2021
Materials regarding the proposed CC&R and Bylaw amendment were sent to all homeowners in April. The goal of the amendments are to eliminate outdated and redundant language in the documents, clarify ambiguous language that can impact the Association’s liability, streamline the election process, and make it easier to amend the documents in the future in order to keep them current with applicable law.
All of the documents that were sent regarding the proposed amendments in April can be viewed on the Resident Portal at resident.actionlife.com in the Documents section of the My Community tab. Please review the documents carefully and submit your completed secret ballot to Action Property Management’s Irvine office by September 30, 2021. Should a sufficient number of ballots be received, the ballots will be opened and tallied at a special meeting, the details of which will be distributed to the membership prior to the meeting. Please note that you must complete an official ballot from the Association in the secret envelopes that were provided in order for your vote to be valid.
Your “YES” vote means you wish to eliminate outdated and redundant language in the documents, clarify ambiguous language that can impact the Association’s liability, streamline the election process, and make it easier to amend the documents in the future in order to keep them current with applicable law.
Your “NO” vote means you wish to leave the outdated documents as they are, which can increase the Association’s liability due to ambiguous language, conflict with current law, and cause the Association to spend more time and money trying to conduct the elections each year in attempts to meet quorum.
All homeowners who have submitted their ballots will be entered into a raffle at the meeting when the ballots are opened and tallied. Six (6) homeowners’ names will be drawn and will be eligible to receive one of the prizes listed below. Please note that you must be in good standing (current in your monthly dues and no active noncompliance issues) to be eligible for a prize.
Grand Prize: $500 Gift Card
Second Prize: $300 Gift Card
Third Prize (4): $100 Gift Card
The Association is still far short of the number of ballots needed. At the July 6, 2021 Board meeting, the Board voted to contract with Communications Lab to canvass the community and knock on the doors of the homeowners that ballots have not been received from to remind them to submit their ballots. The representatives will be able to provide extra voting materials if needed, and homeowners are welcome to fill out their ballot and return it immediately to the representative, or mail it to Management’s office. The canvassing will take place on the weekend of September 11 and 12, 2021.
Homeowners’ participation in this very important process is greatly appreciated! Should you need replacement voting materials or have any questions regarding the proposed amendments, please contact the Community Manager.
